Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Real Estate License Database platform, API, and related services (collectively, the "Service") operated by Northeast Dataworks LLC ("Company", "we", "us", "our"). Real Estate License Database is a product of the Company. By accessing or using the Service, you ("Customer", "you", "your") agree to be bound by these Terms.
1. Use of Service
You agree to use the Service in compliance with all applicable federal, state, and local laws and regulations. You may not abuse, disrupt, reverse-engineer, or attempt to gain unauthorized access to the platform or its underlying infrastructure.
2. Permitted Use
For purposes of these Terms, "Data" means any information or content you obtain through the Service (including via the API). The Data is licensed solely for your internal business purposes, including, but not limited to: identity verification, professional compliance auditing, risk management, and due diligence. Automated bulk extraction from the API for the purpose of creating competing databases or mass-marketing solicitation is strictly prohibited.
3. Prohibited Uses
You may not use data obtained through the Service for any of the following purposes:
- Unsolicited commercial solicitation, including direct mail, cold calling, or commercial email campaigns targeting individuals whose records appear in the Service
- Building or supplementing mailing lists, call lists, or marketing databases for the purpose of direct solicitation
- Any use that violates applicable state open records, public records, or anti-solicitation laws
- Resale or redistribution of bulk data to third parties without prior written consent
- Stalking, harassment, or any unlawful purpose
Certain U.S. states and territories impose specific restrictions on the commercial use of public licensee records. These restrictions vary by jurisdiction and may include prohibitions on using records obtained from state agencies for commercial solicitation. You are solely responsible for understanding and complying with the laws of each jurisdiction whose data you access through the Service.
4. Intellectual Property
While raw regulatory data is public record, the schema, normalization protocols, API architecture, and "Master Index" mapping are the proprietary intellectual property of the Company. You shall not reverse-engineer the normalization logic or attempt to bypass rate-limiting protocols.
5. Accounts and API Keys
You are responsible for maintaining the confidentiality and security of your account credentials and API keys. You must notify us promptly if you suspect unauthorized access. You are liable for all activity that occurs under your account.
6. Data, Availability, and No Official Registry
The Company provides a normalized reflection of state records but is not an official government registry. While the Company employs periodic refresh cycles, you acknowledge that time lags exist between state updates and the API reflecting those updates. Final verification should always be confirmed via the primary state regulatory body.
We strive for accurate and timely data but do not guarantee uninterrupted service, complete coverage, or error-free results. The Service aggregates publicly available information and should not be treated as a substitute for direct verification with the relevant state regulatory body where required by law or regulation.
Coverage of the Service evolves over time. We reserve the right to update the jurisdictions and data sources reflected through the Service, and any representation of current coverage is informational only and subject to change without notice.
7. Indemnification
You agree to indemnify, defend, and hold harmless Northeast Dataworks LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, rule, or regulation, including but not limited to state open records laws, anti-solicitation statutes, or data protection regulations; or (d) any use of data obtained through the Service by you or any party you provide such data to.
The Company shall not be liable for any employment, regulatory, or financial decisions made based on the data provided. You assume all risk for the application of Data in your professional workflows.
8. Limitation of Liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Northeast Dataworks LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You must destroy any data obtained through the Service upon termination, unless retention is required by law.
10. Modifications and Future Acceptance
We reserve the right to modify, supplement, or replace these Terms at any time and in our sole discretion, including changes to pricing, permitted uses, prohibited uses, data handling, jurisdiction-specific restrictions, the indemnification, the limitation of liability, and any other provision. Updates take effect when the revised Terms are posted at this URL with an updated "Last updated" date, or on a later effective date stated in the revised Terms.
By creating an account, generating or using API credentials, or otherwise accessing the Service, you agree in advance to be bound by all such future modifications. Your continued access to or use of the Service after the effective date of any modification constitutes your binding acceptance of the revised Terms, regardless of whether you have separately re-read or re-accepted them.
As a courtesy and not as a condition of enforceability, we will use commercially reasonable efforts to notify the email address associated with your account when changes that we, in our sole discretion, consider material take effect (for example, a meaningful expansion of permitted or prohibited uses, or a change to the limitation of liability). Non-material changes — including clarifications, formatting, typographical fixes, contact-information updates, and the addition of new jurisdictions or data sources — may be made without individual notice. You are responsible for periodically reviewing the current Terms.
If you do not agree to a modification, your sole and exclusive remedy is to stop using the Service and request termination under Section 9. Modifications apply prospectively only; they do not retroactively change the Terms in force at the time of any prior use of the Service.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Massachusetts, without regard to conflict of law principles.
